Terms of Service

§ 1. General Provisions

  1. These Terms of Service define the rules for providing services by Damian Bednarski, operating a business under the name Damian Bednarski, hereinafter referred to as the "Service Provider".
  2. The Terms of Service specify the conditions for order fulfillment, rights and obligations of the Client and Service Provider, rules for submitting and handling complaints, and technical requirements necessary for cooperation with the Service Provider.
  3. The Service Provider provides services to entities conducting business activities and individuals not conducting business activities.
  4. By placing an order, the Client confirms that they have read these Terms of Service and accept their provisions.

§ 2. Definitions

The terms used in the Terms of Service mean:

  • Service Provider – Damian Bednarski, conducting business activities;
  • Client/Customer – a natural person, legal entity, or organizational unit without legal personality placing an order for the Service Provider's services;
  • Website – a website together with all subpages, graphics, and functional elements;
  • Project – a graphic design of the website presented to the Client for acceptance;
  • Agreement – a service agreement concluded between the Service Provider and the Client;
  • Quote – an individual calculation of the costs of performing the order;
  • Materials – content, graphics, photos, texts, and other elements provided by the Client;

§ 3. Scope of Services

  1. The Service Provider provides the following services:
    • Designing and creating websites (business cards, corporate, e-commerce stores);
    • SEO optimization of websites;
    • Website maintenance and support;
    • Modifications and updates of existing websites;
    • Hosting and domain management;
    • Additional services listed in the offer.
  2. The detailed scope of services and their price are determined individually as part of the Quote or result from the selected pricing package.
  3. The Service Provider reserves the right to refuse to perform an order without giving a reason.

§ 4. Order Fulfillment Process

4.1. Placing an Order

  1. The Client contacts the Service Provider via contact form, email, or telephone.
  2. The Client presents their requirements and expectations regarding the project.
  3. The Service Provider prepares an individual Quote or the Client chooses one of the pricing packages.
  4. After accepting the Quote/package, the Client receives confirmation of order acceptance for fulfillment.

4.2. Project Implementation

  1. The project implementation deadline is:
    • Business card website: 7-10 business days;
    • Corporate website: 10-14 business days;
    • E-commerce store: 14-21 business days.
  2. Implementation deadlines are approximate and may change depending on:
    • Project complexity;
    • Timeliness of material delivery by the Client;
    • Number and scope of requested corrections;
    • Force majeure.
  3. The Service Provider informs the Client about project implementation progress.

4.3. Acceptance and Delivery

  1. After completing the work, the Service Provider presents the final result to the Client.
  2. The Client has the right to submit comments and corrections as part of 2 rounds of revisions included in the price.
  3. Each subsequent round of corrections is charged additionally according to the price list.
  4. After the Client accepts the project, the website is published.
  5. Project acceptance means completion of order fulfillment.

§ 5. Client's Obligations

  1. The Client undertakes to:
    • Provide all necessary materials (texts, photos, graphics, logo) by the deadline agreed with the Service Provider;
    • Provide materials in appropriate quality and format;
    • Ensure that the provided materials do not infringe on the rights of third parties;
    • Respond timely to questions and messages from the Service Provider;
    • Make timely payment for services rendered;
    • Provide access credentials to existing services (if applicable).
  2. Delay in providing materials by the Client extends the project implementation deadline.
  3. The Client bears full legal responsibility for the provided materials.

§ 6. Service Provider's Obligations

  1. The Service Provider undertakes to:
    • Perform the service according to the arrangements and within the agreed deadline;
    • Maintain confidentiality of received information and materials;
    • Regularly inform about project implementation progress;
    • Create the website according to best practices and web standards;
    • Ensure website responsiveness (mobile device adaptation);
    • Basic SEO optimization;
    • Test the website before publication.
  2. The Service Provider is not responsible for:
    • Legal compliance of content provided by the Client;
    • Infringement of copyrights or other rights by materials provided by the Client;
    • Search engine positioning results (SEO is optimization, not a guarantee);
    • Failures of third-party hosting servers;
    • Actions of third parties (hacker attacks, spam, etc.).

§ 7. Payments

7.1. Prices and Payment Methods

  1. Service prices are quoted in US dollars (USD) and include VAT tax (if applicable).
  2. Payments can be made:
    • By bank transfer to the Service Provider's account;
    • Online payment (if available);
    • Cash (upon personal collection).
  3. Payment deadlines:
    • 50% deposit of the project value - before starting work;
    • Remaining 50% - before website publication;
    • Maintenance packages - paid in advance at the beginning of each month;
    • Individual changes - paid in advance before implementation.

7.2. Payment Delays

  1. In case of payment delay, the Service Provider has the right to:
    • Suspend project implementation;
    • Suspend the website;
    • Charge statutory interest for delay;
    • Withdraw from the agreement.
  2. After 30 days from the payment deadline, the Service Provider has the right to delete the website and materials without further notice.

§ 8. Copyright

  1. All copyrights to the created website belong to the Service Provider until full payment.
  2. After full payment for the project, copyrights to the website (excluding standard solutions and frameworks used) transfer to the Client.
  3. The Service Provider reserves the right to:
    • Place author information in the website footer;
    • Use the completed project for self-promotional purposes (portfolio, case study);
    • Use solutions and code fragments in other projects.
  4. The Client may not use the website's source code to create further commercial projects without the Service Provider's consent.

§ 9. Hosting and Domain

  1. As part of the service package, the Client receives:
    • Hosting - server space for a period of 12 months (free with maintenance package selection);
    • Domain - .pl or .com domain registration for a period of 12 months (free with maintenance package selection).
  2. After 12 months:
    • With continuation of maintenance package - hosting and domain remain free;
    • Without maintenance package - the Client bears renewal costs (hosting ~$28-42/year, domain ~$14-22/year).
  3. The Service Provider is not responsible for:
    • Data loss in case of lack of backups (available in maintenance package);
    • Domain expiration in case of non-renewal;
    • External hosting failures.
  4. The Client has the right at any time to transfer the website to their own hosting after receiving files and databases.

§ 10. Maintenance and Support

  1. The maintenance package includes:
    • Hosting and domain;
    • Regular backups;
    • Security updates;
    • 24/7 monitoring;
    • Technical support;
    • Minor content corrections (within the agreed hour limit).
  2. The maintenance package is paid monthly in advance.
  3. The Client may cancel the maintenance package with 30 days' notice.
  4. After canceling the package, the Client receives all files and is responsible for further website maintenance.

§ 11. Changes After Project Completion

  1. Changes and modifications to the website after its completion are paid according to the price list ($21 per change).
  2. A change includes a single operation, e.g.:
    • Text change in one section;
    • Adding/removing one photo;
    • Updating contact details;
    • Adding a new blog post.
  3. Major changes (e.g., adding new functionality, redesigning a section) require an individual quote.
  4. Change implementation time: 1-3 business days.

§ 12. Complaints

  1. The Client has the right to file a complaint in case the service provided does not comply with the agreement.
  2. The complaint must be submitted in writing (email) within 7 days of website publication.
  3. The complaint should include:
    • Client's details;
    • Description of the problem;
    • Client's expectations;
    • Materials documenting the problem (screenshots, etc.).
  4. The Service Provider will respond to the complaint within 14 business days.
  5. In case of a justified complaint, the Service Provider undertakes to remove defects free of charge.
  6. The complaint does not cover:
    • Problems resulting from the Client's actions;
    • Changes in requirements after project acceptance;
    • Subjective aesthetic preferences;
    • Problems resulting from using outdated browsers.

§ 13. Withdrawal from the Agreement

  1. The Client has the right to withdraw from the agreement before starting project implementation without giving a reason.
  2. After starting work, the Client may withdraw from the agreement with the following consequences:
    • Refund of 50% of the paid deposit if the project has not exceeded 25% progress;
    • No deposit refund if the project has exceeded 25% progress;
    • Obligation to pay for work performed proportionally to progress.
  3. The Service Provider has the right to withdraw from the agreement in case of:
    • Payment delay exceeding 14 days;
    • Lack of cooperation from the Client (no response for 30 days);
    • Violation of Terms of Service provisions by the Client;
    • Force majeure making project implementation impossible.
  4. In case of withdrawal by the Service Provider for reasons attributable to the Client, the paid deposit is non-refundable.

§ 14. Personal Data Protection (GDPR)

  1. The personal data administrator is Damian Bednarski.
  2. Personal data is processed solely for the purpose of fulfilling the agreement and contacting the Client.
  3. The Client has the right to:
    • Access their data;
    • Rectify data;
    • Delete data (after ending cooperation);
    • Restrict processing;
    • Data portability;
    • Object to processing.
  4. Details of data processing can be found in the Privacy Policy.

§ 15. Final Provisions

  1. In matters not regulated in these Terms of Service, the provisions of the Civil Code shall apply.
  2. The Service Provider reserves the right to change the Terms of Service. Changes come into effect on the day of their publication.
  3. Changes to the Terms of Service do not apply to agreements concluded before the date of entry into force of the changes.
  4. Any disputes arising from the implementation of agreements will be settled by the court competent for the Service Provider's registered office.
  5. The Terms of Service come into effect on January 4, 2026.

These Terms of Service have been prepared in accordance with Polish law, including the Consumer Rights Act, the Act on the Provision of Electronic Services, and GDPR.
